A: ICBC or the court might conclude that no driver was at fault in your accident. If this happens, you will not be able to recover any damages, even though you were an innocent passenger in the accident. Examples of such accidents are:
a) when a vehicle collides with an animal on the road,
b) when a vehicle hits black ice or an isolated patch of snow or other slippery substance on the road which could not have reasonably been anticipated, or
c) when a vehicle’s tire blows, even though the tire was apparently in good condition.
Your driver may be found at fault in these circumstances:
a) if he or she was driving too fast for road conditions, or
b) if he or she was not fully paying attention to the road ahead.
Under these circumstances, you may want to obtain legal advice before you visit ICBC.
