Q: I lost the chance to earn more money after my collision than I earned before the collision. Am I entitled to be compensated for this?
 

A: Yes, if you can prove that there is a real possibility (more than speculation) that you would have earned more money after the collision than you earned before the collision. However your loss must be discounted to take into account the chances that you would have earned this additional income.

A B.C. Court of Appeal justice wrote: “While past work history is not determinative of what will occur in the future, it is a significant factor to consider when estimating the likelihood of what would have happened in the future but for the accident.” Therefore you will need solid evidence to support this claim. Such evidence can vary greatly. It can include the evidence of employers about your work performance prior to the accident and opportunities you missed after the accident and the evidence of an economist on the job opportunities and average incomes in your field.
