Q: How should I prepare for my examination for discovery regarding possible video surveillance of me?
 

A: When ICBC’s lawyer asks you questions under oath at your examination for discovery, you should clearly admit to attempting various activities but explain the consequences of doing the activities.

If ICBC’s lawyer asks you questions to see if you could do certain activities at a certain time, it may mean that ICBC has some videotaped evidence during that period. Many lawyers are more subtle in their questioning, so you should prepare for your examination for discovery by reviewing your diary to see what activities you attempted but suffered pain afterwards.
