Judge awards $110,000 for pain & suffering to young lady with permanent low back & hip pain

Ms Young, 34, was injured in an mva six years prior to her trial. Her injuries developed into chronic pain. The judge considered a number of factors, including Ms Y’s ongoing pain & mental health issues in making his award.

 

In addition to chronic pain in her lower back, Ms Y had hip injuries that were not fixed with surgery. Chiro & physio treatment had caused ‘flare-ups’ of her pain.

 

Her treating orthopaedic surgeon was of the opinion that she would likely never make a full recovery & would probably not regain all of her pre-accident abilities.

 

Ms Y also suffers from clinical depression & anxiety as a result of her mva. The judge found they would likely resolve in the future as her treatment and recovery continues.

 

Taking these issues into account, Mr. Justice Grauer awarded Ms Y $110,000 for her pain & suffering.
